Miller Petroleum, Inc. is unable to file its Form 10-QSB for the period ended January 31, 2007 (the “Form 10-QSB”) within the prescribed time period without unreasonable effort or expense because it requires additional time to review and complete its Form 10-QSB and accompanying financial statements due to its limited financial resources and available personnel.

Part IV - Other Information, Item (3)

The Company’s revenue for the three months ended January 31, 2007 is expected to be approximately $200,049 as compared with revenue of $424,605 for the three months ended January 31, 2006.

The Company’s revenue for the nine months ended January 31, 2007 is expected to be $1,113,607 as compared with revenue of $2,108,735 for the nine months ended January 31, 2006.
 
The decreased revenue during the three and nine months ended January 31, 2007 is attributable to the Company changing oil vendors such that oil was not collected for approximately one month, requiring a cessation of production; and to a decrease in drilling activity.
